Incorporation is the legal process of forming a new corporation by filing Articles of Incorporation (or Certificate of Incorporation) with a state government. The act of incorporation creates a separate legal person — the corporation — that can own property, enter contracts, sue and be sued, and exist perpetually independent of its founders.
While 'incorporation' technically refers only to forming corporations, it is colloquially used to describe forming any business entity (including LLCs). The formal term for creating an LLC is 'organization' (hence 'Articles of Organization'), not incorporation.
